Standard Trading Terms and Conditions
- Scope of Services:
Freight and Customs International Pty Ltd provides domestic and international freight forwarding, coordination of logistics, and customs brokerage services in accordance with the laws of Australia. The Company is the Agent of the Client in organizing the transportation, customs clearance, and ancillary arrangements except otherwise specifically agreed in writing. - Client Obligations:
The Client will produce sufficient and correct shipping documentation, including commercial invoices, packing lists, permits, and all other documentation required for customs clearance under the Customs Act 1901 and other applicable Australian legislation. Company responsibility for delay, penalties, or fines that may arise from incorrect or incomplete documentation submitted by the Client will not be accepted. - Limitation of Liability:
To the fullest extent permitted by Australian Consumer Law, Company's liability for loss, damage, or delay is limited to the lower of:AUD $100 per consignment; or Client declared value of the goods.Company will not be liable for indirect, special, or consequential loss unless prior written consent and additional insurance cover are agreed. - Terms of Payment:
All service charges are due for payment within 14 days of invoice date. A charge of interest of 2% per month may be made for late payment. The Company may withhold or suspend any services for any Client account that has an outstanding balance.. - Governing Law and Dispute Resolution:
These Terms and Conditions are to be construed in accordance with the law of Western Australia and the Commonwealth of Australia. All disputes arising hereunder will be settled by good faith negotiation. In the event that they cannot be so settled, disputes may be referred to arbitration under the rules of the Australian Centre for International Commercial Arbitration (ACICA).
